at the moment I'm hitting about 60hrs+ a week but hopefully it'll ease off shortly. hopefully!

I don't think there is anyone else round here
actually, I was wrong. I've just run the numbers and over the last 12 months I've averaged 199hrs per month which over a year (minus holidays etc) that means I average 52hrs a week. I wonder if I can opt back in to the EU "no overtime" law ......

rarely do i work more than 40 in a week. but our clients know that if they call us after hours that we charge double so it tends to limit them to actual, real emergencies before they pick up that phone

well I was doing 45-50 a week and was getting alot done around here but the economy caused the owners to redo my scedule and to say "no more o/t". If I have to work extra for something then I take more time off in the same time frame to fix it.
So no I am 38-40 hrs per week and hating it. But at least I still have a job.

Yes you can, at any time. You tell your employer in writing that you wish to opt-out of your opt-out.
The Working Time Directive gives you certain statutory rights.
It is illegal for you to be discriminated against for exercising a statutory right (whatever it is).
If you are overlooked for a pay review, it is impossible to prove that you have been discriminated against for this or any other partivcular reason though, unless the HR manager sends an email to your boss saying "this troublemaker is getting nothing this year because..."
Note that opting back in does not mean:
- you are not allowed to work or claim pay for more hours (it prevents you being required to work more hours
- you cannot be asked to work more hours in a particularly busy week (it only prevents you being required to work more than the set number of hours (48?) on average in any rolling 13 week period)
